Terms of Service

These Terms govern your use of Gravity Funding’s trader evaluation platform, simulated trading environment, dashboard, payment systems, account services, certificates, and payout request features.

Important Notice

Gravity Funding provides simulated trader evaluation services. We are not a broker, exchange, investment adviser, asset manager, bank, or custodian. Unless expressly stated otherwise, accounts provided through the platform use simulated funds and are operated for evaluation purposes.

1. Acceptance of These Terms

These Terms of Service govern your access to and use of Gravity Funding, including our website, trader dashboard, evaluation programs, simulated trading accounts, payment flows, account management tools, certificates, payout request systems, support channels, and any related products, features, content, or services provided by Gravity Funding.

By accessing the platform, creating an account, purchasing an evaluation, using a dashboard, receiving trading credentials, participating in any program, or submitting a payout request, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, you must not access or use Gravity Funding.

3. Eligibility and User Representations

You may only use Gravity Funding if you are legally permitted to do so under the laws and regulations applicable to you. By using the platform, you represent and warrant that:

  • you have the legal capacity and authority to enter into these Terms;
  • the information you provide is accurate, complete, and not misleading;
  • you are not using false, stolen, synthetic, or unauthorized identity information;
  • you are not located in, resident of, or ordinarily operating from a prohibited jurisdiction;
  • you are not subject to sanctions, watchlists, or restrictions that prohibit platform access;
  • your use of the platform complies with all laws applicable to you.

Gravity Funding may reject, suspend, restrict, or terminate access where eligibility cannot be verified or where continued access may expose Gravity Funding to legal, regulatory, payment, fraud, operational, or reputational risk.

4. Account Registration and Security

You are responsible for maintaining the confidentiality and security of your login details, dashboard access, trading credentials, connected devices, email account, payment accounts, wallet addresses, and any activity performed through your account.

You must not sell, rent, transfer, share, sublicense, or allow another person to access or operate your Gravity Funding account unless expressly permitted in writing by Gravity Funding. You are responsible for all actions taken through your account, whether authorized by you or not.

If you suspect unauthorized access, credential compromise, device compromise, payment fraud, or suspicious account activity, you must notify Gravity Funding support immediately.

5. Evaluation Programs and Simulated Accounts

Gravity Funding may offer evaluation challenges, funded-stage simulations, pay-after-pass programs, free accounts, promotional accounts, competitions, or other trader assessment programs. Each program may have different fees, account sizes, trading objectives, limits, payout terms, restrictions, eligibility requirements, and account rules.

Account balances, equity values, profits, losses, drawdowns, statistics, and trading results shown in the platform may represent simulated performance and may not represent real client funds, live brokerage execution, or actual market ownership by the user.

Program names, account sizes, virtual capital amounts, profit targets, payout percentages, and dashboard displays are for evaluation and platform operation purposes. They do not create a promise that the user has received real money, a loan, a deposit, a securities account, a managed account, or guaranteed access to live trading capital.

6. Trading Rules and Objectives

Every evaluation or account program is subject to its applicable rules. Rules may include, but are not limited to:

  • profit targets;
  • daily loss limits;
  • maximum total drawdown limits;
  • minimum trading days;
  • maximum trading days or account expiry;
  • risk limits, lot limits, leverage restrictions, and exposure limits;
  • news trading restrictions;
  • weekend holding restrictions;
  • consistency rules;
  • copy trading restrictions;
  • prohibited strategy rules;
  • platform abuse and data manipulation rules;
  • identity, device, IP, KYC, and payout verification requirements.

You are solely responsible for reading, understanding, and following the rules that apply to your selected program. Failure to comply with any applicable rule may result in account breach, failed evaluation, payout denial, account reset refusal, suspension, termination, or loss of access.

7. Prohibited Trading Practices

Gravity Funding may prohibit practices that are inconsistent with legitimate trading, realistic execution, fair evaluation, platform integrity, or responsible risk management. Prohibited conduct may include, without limitation:

  • using latency arbitrage, quote delay exploitation, or platform pricing errors;
  • using reverse arbitrage, hedge arbitrage, or unrealistic execution exploitation;
  • placing trades intended only to exploit demo-server conditions;
  • using high-frequency order flooding or server abuse techniques;
  • copying trades from other users, groups, signal rooms, account managers, or prohibited sources;
  • coordinated trading between multiple accounts or users to manipulate outcomes;
  • using multiple accounts to bypass drawdown, payout, exposure, or rule limits;
  • trading in a way that cannot reasonably be replicated under real market conditions;
  • using bots, scripts, software, APIs, or automation in a manner not permitted by the program rules;
  • attempting to alter, spoof, manipulate, or falsify trading data, device data, or account records.

Gravity Funding may determine, in its sole discretion, whether a trading practice is abusive, unrealistic, manipulative, or prohibited. Gravity Funding may update prohibited practice rules to protect the platform, its users, liquidity relationships, technology, and business operations.

8. Account Breaches, Reviews, and Final Decisions

Account breaches may be detected automatically or manually through platform data, trading records, server logs, rule-engine results, dashboard records, device data, payment records, support evidence, third-party data, or administrative review.

Gravity Funding may suspend, restrict, fail, review, or close an account if a rule breach, prohibited strategy, suspicious activity, duplicate account, payment dispute, identity issue, technology abuse, or platform integrity concern is detected.

Gravity Funding may reverse an incorrect account status where a technical error, data mismatch, payment error, system bug, duplicate processing event, dashboard mistake, or incorrect rule application is discovered. Platform records, backend records, trading system records, audit logs, and OpenBook-generated status updates may be used to determine final account outcomes.

Gravity Funding reserves the right to make final determinations regarding account status, breach status, payout eligibility, and program completion, subject to applicable law.

9. Payments, Fees, and Order Processing

Evaluation fees, account access fees, reset fees, subscriptions, add-ons, upgrades, promotions, or other charges may be required to access certain services. All prices, discounts, promotions, and account offerings may change at any time before purchase.

Gravity Funding will only activate paid services after payment has been verified by the payment provider and confirmed by Gravity Funding’s backend systems. Screenshots, frontend payment messages, wallet broadcasts, bank notifications, or user-submitted proof do not guarantee account activation unless confirmed by Gravity Funding’s systems.

Gravity Funding may cancel, correct, reverse, or refuse an order where there is a pricing mistake, payment mismatch, duplicate order, chargeback risk, suspected fraud, payment provider error, currency conversion issue, unsupported payment source, or technical processing mistake.

10. Refund Policy

Unless expressly stated otherwise in a specific offer or required by applicable law, fees paid to Gravity Funding are non-refundable once the user receives dashboard access, account access, trading credentials, evaluation access, or any digital service connected to the purchase.

Refunds may be denied where an account has been created, accessed, traded, breached, suspended, reviewed, upgraded, reset, or where the user violated these Terms, program rules, payment rules, or verification requirements.

Promotional offers, discounted accounts, free accounts, bonus accounts, competitions, and special access programs may have separate refund restrictions or may be non-refundable by default.

11. Chargebacks, Payment Abuse, and Fraud

You must not misuse payment systems, initiate fraudulent chargebacks, submit false payment claims, use unauthorized payment methods, exploit discounts, resell accounts, or attempt to obtain account access without valid payment.

If a payment is disputed, reversed, charged back, flagged, refunded, or suspected of fraud, Gravity Funding may immediately suspend or terminate access, cancel accounts, deny payouts, revoke certificates, restrict future purchases, and recover costs to the extent permitted by law.

12. Payouts, Rewards, and Eligibility

Payouts, rewards, or profit-share payments are not guaranteed. They are subject to the applicable program rules, account status, platform review, identity verification, trading review, risk review, payout cycle requirements, minimum thresholds, payment provider availability, and Gravity Funding approval.

Gravity Funding may delay, reduce, reject, cancel, or withhold a payout where there is a suspected rule breach, prohibited strategy, KYC issue, duplicate account, payment dispute, chargeback, suspicious trading pattern, technical inconsistency, wallet issue, sanctions concern, legal restriction, or platform integrity concern.

Where payouts are processed through USDC, stablecoins, cryptocurrency, bank transfer, or third-party providers, you are responsible for submitting accurate payout details. Gravity Funding is not responsible for losses caused by incorrect wallet addresses, wrong networks, unsupported wallets, bank errors, blockchain delays, third-party processing issues, or user-submitted payout mistakes.

Any payout, reward, or certificate issued by Gravity Funding may be corrected, revoked, or reversed if later found to have resulted from error, fraud, breach, prohibited conduct, payment reversal, or inaccurate data.

13. Taxes

You are solely responsible for determining, reporting, and paying any taxes, duties, levies, or charges that may apply to payments, rewards, payouts, promotions, crypto transfers, or other amounts received in connection with Gravity Funding.

Gravity Funding does not provide tax advice and may request tax forms, declarations, or identity information where required by law, payment providers, or internal compliance procedures.

14. Identity Verification, KYC, AML, and Compliance

Gravity Funding may require identity verification, proof of address, payment verification, wallet verification, device verification, video verification, tax information, or other compliance checks before allowing access, approving payouts, issuing certificates, or continuing services.

You agree to provide accurate and complete verification information when requested. Failure to complete verification, submission of false information, use of third-party accounts, or suspicious activity may result in suspension, payout denial, account closure, or permanent restriction.

15. Restricted Jurisdictions and Sanctions

Gravity Funding may restrict access from certain countries, regions, territories, persons, entities, or networks where required by law, payment provider policy, sanctions rules, business risk controls, or internal compliance standards.

You must not use VPNs, proxies, false addresses, identity masking tools, or third-party accounts to bypass jurisdiction, sanctions, payment, eligibility, or compliance restrictions.

16. Platform Availability and Technical Errors

Gravity Funding aims to provide a stable and secure platform, but we do not guarantee that the website, dashboard, trading terminal, account provisioning, payment systems, APIs, charts, data feeds, certificates, or support systems will be uninterrupted, error-free, instant, accurate at all times, or permanently available.

Gravity Funding is not liable for delays, losses, failed evaluations, missed opportunities, data inconsistencies, payout delays, account issues, or service interruptions caused by internet failures, cloud providers, payment providers, trading platforms, broker integrations, liquidity providers, market data providers, API outages, cyberattacks, maintenance, force majeure, or events outside our reasonable control.

Gravity Funding may correct platform mistakes, including incorrect pricing, incorrect account allocation, duplicate account creation, wrong dashboard status, incorrect payout display, certificate mistakes, calculation errors, or data synchronization issues.

17. Data Accuracy and Dashboard Displays

Dashboard values, account statistics, drawdown calculations, profit calculations, payout eligibility indicators, certificate status, account status, and rule progress may be delayed, approximate, cached, pending verification, or subject to backend reconciliation.

Where there is a conflict between frontend dashboard information and backend records, payment provider records, OpenBook records, trading server records, audit logs, or administrative review, Gravity Funding may rely on the records it considers most accurate and authoritative.

18. Third-Party Services

Gravity Funding may rely on third-party services, including payment processors, trading platforms, market data providers, cloud providers, identity verification providers, analytics tools, email/SMS providers, crypto networks, and infrastructure providers.

Gravity Funding is not responsible for third-party outages, delays, errors, fees, restrictions, compliance actions, rejected transactions, payment failures, network congestion, wallet issues, data feed problems, or service limitations caused by third parties.

19. No Guarantee of Results

Gravity Funding does not guarantee that you will pass an evaluation, receive a funded status, qualify for a payout, earn rewards, improve your trading, or achieve any financial result. Trading-related activities involve risk, and past performance does not guarantee future results.

Any testimonials, certificates, dashboards, payout posts, marketing materials, statistics, or user results are not promises that you will achieve the same or similar outcome.

20. User Conduct and Platform Abuse

You must not:

  • hack, attack, overload, scrape, reverse engineer, or disrupt the platform;
  • attempt to bypass authentication, authorization, rate limits, or security controls;
  • tamper with payment, account, dashboard, trading, or payout systems;
  • use stolen cards, unauthorized wallets, or third-party payment accounts;
  • harass, threaten, abuse, impersonate, or defame staff, users, partners, or affiliates;
  • submit false documents, edited screenshots, fake payment proof, or manipulated records;
  • resell, rent, transfer, manage, or commercially exploit accounts without written approval;
  • use the platform for unlawful, fraudulent, harmful, or deceptive purposes.

21. Intellectual Property

Gravity Funding owns or licenses all rights in the platform, including its brand, logos, website, dashboard, terminal interfaces, software, source code, systems, documentation, designs, text, graphics, workflows, databases, APIs, certificates, content, and related materials.

You may not copy, reproduce, sell, license, distribute, scrape, clone, modify, reverse engineer, or create competing services from Gravity Funding materials without prior written permission.

22. Communications and Notices

Gravity Funding may contact you through email, dashboard notices, SMS, WhatsApp, Telegram, Discord, support tickets, or other communication channels connected to your account.

You are responsible for keeping your contact information accurate and for checking official communication channels. Gravity Funding is not responsible for missed notices caused by incorrect contact information, spam filters, blocked messages, or failure to monitor your account.

23. Suspension and Termination

Gravity Funding may suspend, restrict, or terminate your account or access to any service at any time where we believe you violated these Terms, breached program rules, abused the platform, created business risk, submitted false information, initiated abusive chargebacks, failed verification, engaged in suspicious activity, or violated applicable law.

Suspension or termination may result in loss of access to evaluations, dashboards, trading accounts, certificates, payout requests, promotions, community access, and related services.

24. Indemnification

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Gravity Funding, its owners, directors, officers, employees, contractors, affiliates, service providers, and partners from any claims, damages, losses, liabilities, costs, penalties, and expenses arising from your use of the platform, violation of these Terms, violation of program rules, violation of law, fraud, payment abuse, misuse of the platform, or infringement of any third-party rights.

25. Limitation of Liability

To the maximum extent permitted by law, Gravity Funding shall not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, including damages related to failed evaluations, account closures, denied payouts, incorrect trading decisions, platform downtime, payment delays, third-party failures, data errors, dashboard inaccuracies, cyber events, or inability to access the platform.

To the maximum extent permitted by law, Gravity Funding’s total liability for any claim shall not exceed the amount you paid to Gravity Funding for the specific service giving rise to the claim during the three months before the claim arose, or one hundred US dollars (US$100), whichever is lower, unless applicable law requires otherwise.

26. Dispute Resolution

Before starting any formal dispute, you agree to contact Gravity Funding support and allow us a reasonable opportunity to review and resolve the issue. You must provide complete information, including your account email, order ID, relevant screenshots, transaction references, and a clear description of the issue.

Any dispute resolution, arbitration, court venue, governing law, limitation period, class action waiver, or consumer protection language must be completed according to the legal jurisdiction selected by Gravity Funding and reviewed by qualified legal counsel before publication.

27. Changes to These Terms

Gravity Funding may update these Terms at any time. Updates become effective when posted on the platform, unless a later effective date is stated. Your continued use of Gravity Funding after updated Terms are posted means you accept the updated Terms.

If you do not agree to updated Terms, you must stop using the platform.
